I'm ok with it, somebody has to make these marketing execs stick to the truth and not exaggerate. It's been said that nobody believes what the marketing says, but you have to ask yourself why it got this way and how it became acceptable to tell lies and get away with it.

It's quite common in the UK for ads to get pulled because they don't live up to their claims, even though a lot of stuff gets through.

I'm not suggesting that she gets the $5million, but they should have to re-print the packaging.

It's like buying a car that they say does 0-100 in 6 seconds and finding the reality closer to 9 seconds, would that be OK?

I can't view the content from the UK, but that is just insane! How has the Company possibly caused this woman a personal loss of $5m? Even accounting for the intense emotional distress she must have experienced when she discovered she needed to give it another 2 mins at 800W, I'd say the true merit of her claim is $1, tops. I hope the greedy cow racks up a fortune in lawyers' fees, then sees the case thrown out of court.

Is there a lawyer involved? Probably a shyster.

pretty sure you can sue anyone for anything in the usa if you can fill out the correct stuff and pay the filing fee.

Not lately. But, Yeah, this was an expensive pen for sure!

I shot that shell sometime around 2005 when they were about $6.50 a round if you bought in bulk. My uncle got his hands on some slugs, drilled them and made us all pens to commemorate the day we shot a .50 cal rifle for the first time.

I admit I did not look this case up. But years ago the "wrong" lawyer showed up at a professional training workshop, and he offered to stay on and discuss whatever random ridiculous-sounding legal cases we'd seen in the news, and give us the background. From memory, one case involved a very drunk party-goer jumping into the pool from the roof, hurting himself, and suing his host. And another involved a very drunk party-goer -- hmmm, sensing a theme -- falling downstairs, hurting himself, and suing the landlord. In both cases there were fuller circumstances that did make sense of these lawsuits. So, I dunno.
