So this weekend somebody commented on one of my tunes saying "...I have to point out that this sounds just like "Take a Picture" by Filter, same chords and rhythm".

I am a fan of Filter and back in the day I listened to the albums "Title of Record" and "Short Bus" quite a bit. It's been 10, maybe 15 years since I've listened to either and "Take a Picture" was honestly never my favorite tune of theirs. I never picked up a guitar to try and play along with any Filter songs.

So I had a listen and had an immediate "holy s*&t, he's right!!!". My tune is a slower tempo but it's the same rhythm on the guitar even with the same embellishments.

It gave me insight as to how easy it is to inadvertently copy something.

Check it out, just the first minute of each:

I once had recorded a melody I was rather proud of and then realized it was basically a Jazz cover of a Justin Bieber song.
To be fair, not that many people remember Filter these days so you might have gotten away with it :whistling:;)

From a legal standpoint I'd probably be OK since the melody is different. It was just shocking to me how close the opening rhythm guitar parts are.

Even if Filter was still a thing today, I'm totally insignificant to Richard Patrick, so it's all good. If he wants I can send him the ~$5 or so I've made from the song LOL.

Is there only me that thinks Lionel Richie's "Stuck on you" and Eric Clapton's "Wonderful tonight", have the same riff ?

    Well thanks for that!! :)

Once you get into the meat of the songs it's different, but it was just funny to me how the intro of the Filter tune plays those same chords in the same rhythm...on an acoustic guitar! I can hum the melody of my tune over the intro to "Take a Picture".

I'd have to look up that Lionel Richie song but it wouldn't surprise me. There is a Goo Goo Dolls song where the chord progression and rhythm are reminiscent to Billy Joel's "Piano Man". Once you hear it, it's hard to unhear it.

And, come to think of it, parts of Stairway to Heaven sounds a lot like Taurus. Someone should look into that.

I have this thing that I keep playing that would sound great as the opening part of an 80's instrumental kind of thing but it sounds so familiar. I don't know if it's because I subconsciously copied it or if it's because I've played it so many times.

There is nothing new under the sun. The only thing that's "new" is the presentation.

The progression is similar. The melody isn't. Contrafacts....songs with different melodies over the same progression or form are as old as dirt.

The Star Trek Theme is an old tune called Out Of Nowhere.

Your tune is as original as the Filter tune is.

When you start nicking melodies that's troublesome. But progressions...rhythm...not something you can copyright. At least until Blurred Lines.

I know how you feel BS; I was once accused of copying a certain song (can't even remember which one it was now), and I'd never even heard of it before!
On saying that, considering that there is only a certain number of notes that we can play with, it's not surprising that we get accused occasionally.

You're so right. Everytime you play 12 bar, or do pentatonic licks, chances are you'll be copying somebody:(

Thanks to your post I learned that "Take a Picture" was by the same band that made "Hey Man Nice Shot". I had no idea!

Anyway, I can hear the similarities since you pointed them out, but overall two very different songs and I like yours better!

I think we can't help be in large part a sum of our influences. I wasn't influenced by Filter, but if I remember correctly, Richard Patrick (who IS Filter) is the same age as I. I bet he and I have some influences in common, such as The Who's Tommy.

First off...that's really kind of you to say...thank you!

Yeah, the song couldn't be more atypical for the band. The reason I never really liked "Take a Picture" was it was so different from their usual, like "Hey Man Nice Shot". Older me can appreciate that "Take a Picture" is a nice tune.
